It's clear that any alien can simply claim (with no evidence) abuse and obtain an "automatic" police report and an "automatic" restraining order and put together the elements needed to submit to the Vermont Service Center and have a good chance of getting a permenant resident card at the expense of an American or sponsor.
How does this affect the American sponsor who signed the Affidavit of Support?
Does a prenuptuial agreement (before getting married) waiving alimony stand against the I-864 Affidavit of support (after getting married)?
Whether you get a divorce or annulment would the American need to prove marriage fraud to avoid this contract agreement?
Has anyone had the immigrant spouse sign a divorce agreement waiving alimony from their state laws AND Title 8 Section 213A ??
I have seen a mix of feedback concerning whether a sponsor has to provide a check to the spouse to maintain poverty level. Can anyone respond to any knowledge or experience to if a sponsor is ordered to pay a support check?
