 Post subject: Please Help: Wading through the System -hard to get answers

I am new to this site and thought perhaps someone who lived through this mess can give me some reassurance. I am the victim of marriage fraud. I'll try to make this short...I was stuck in a well-documented abusive marriage - that turns out was never legal as the foreigner I thought I married was still married to someone in his home country. Turns out now that he wasn't eligible to marry me until around 4 years after we supposedly "got married." He lied on his immigration docs and said that he was never married before and didn't have any kids in his home country, when he had two children. In addition, he came on a visitor's visa and married me two days after his arrival here - worked here without permission for around 3 years - basically didn't do a thing legally. I didn't find out all of this until he wanted to try for citizenship and an immigration attorney he hired said he couldn't do so because he entered on the basis of a bigamous marriage to me that was never legal. He has held a permanent resident card issued on the basis of his fraudulent marriage to me.

So I finally got all the documents to substantiate the fraud from his home country and turned it all in to immigration. I withdrew my petition and affidavit of support on his behalf. I am also working on an annulment in the local courts. It has been a couple of months since I turned in everything and it just has seemed to drop into the black hole at CIS. I haven't received any acknowledgement of my submittal or anything. Just total nothing. How can I be certain that there is some justice served in my case? Do I need to follow up with the investigator? What more do I need to do to see some justice? What can I expect from CIS/ICE? How long does it take to see some action? I hope someone can help me as it just seems hopeless to get anything moving with the feds. Thanks for your help. I appreciate anyone who can offer a voice of some experience...[/b]

I would contact jnSampson, a member of this website. He is a retired INS/ICE agent with 27 years experience. He has a consulting and investigation business and is an expert witness for court trials. He knows the levers you can pull to get the information you need and hopefully some justice. You have a very good case for the later.

The annulment is important to complete. Once a judge declares your marriage void, you should be free from any obligations or liabilities associaed with that man.

May or may not be true.

In terms of legal obligations ex-immigration it turns whether the marriage was void at inception or voidable. In the later obligations are valid until the time the marriage is voided by court action.

Petitions obligating you for support to USCIS are not impacted by whether the marriage was annulled or divorced.
