I'm new to the group and am a friend and biz partner to someone who's a victim of marriage fraud. So, I'll be asking questions on his behalf. I am originally from Texas, but we both live in California (Ventura area) at the moment, starting our business.
His Russian wife seemed to have followed the Green Card Hunters Playbook nearly word-for-word. They have a child together and she brought her 16 year old son with her. She physically and mentally abused him AND both children and charges have been placed against her for an accused incestuous relationship with her 16 year old (outside of the spousal abuse charges placed on HIM which were dismissed). He was granted temporary custody of their 2 year old daughter however, the boy was temporarily given back to his wife until this case is settled. He, with his daughter, moved to California for work. Protective orders were put in place to protect both him and his daughter. His wife was given 2 hours supervised visitation a month.
In the LAST court date, for some insane reason, the judge granted her regular UNSUPERVISED visitation, even though she has sexual and physical abuse charges against her. Plus, they're familiar with the high alert/fear of her leaving the country or at least the state (going into hiding) with the child because the judge said that the wife must hand over the baby's passport before she's allowed to visit.
Lots of people are talking about divorce in these cases, but he'd like to investigate the possibility of an annulment, instead, based on the strong fraud case.
Since a court in Texas currently holds this case, would it be more helpful for him to acquire a new attorney (not happy with his current divorce attorney) in Texas or should he search for one in Ventura? Also, he's searching specifically for an attorney who specializes in annulments/Russian marriage fraud - how do you find those type of people?
Oh another thing - she somehow acquired fabricated documentation stating she had no communicable diseases, when she came into the country. We know this to be true because when she got pregnant her doctor discovered she had tertiary syphilis (5 years or longer). Tertiary syphilis results in a list of nasty symptoms/damages - mental illness, specifically. So now, she's also committed immigration fraud or something against homeland security AND she possibly has mental illness. She refuses to take a psych exam.

What I did was get out the Yellow pages and look for an immigration attorney that has Russian language interpreters on staff. Set up an appointment with this attorney. There maybe a consulting fee. In my case it was $170 for an hour. Besides telling this attorney the details of the case the real objective would be to get a recommendation of the best annulment/divorce attorney that they would use. They know which attorneys in the area that know the real issue with an immigrant when their immigration status is endangered. Most attorneys do not have this experience and may recommend a course of action based on the usual problems of a usual American divorce. BTW I co-wrote "the Green Card Huntress" with Elena Garrett. She has a detective agency that does background checks in Russia/Ukraine www.Russian-Detective.com . I have used her services and she did well by me. There seems to be a lot of fraudulent documents and hidden pasts with these cases. Another person that knows the ropes is JnSampson of this board. He has 27 years experience with the INS/ICE as an investigator and has a consulting and expert witness business for victims of immigration fraud.

You have no final texas orders but have acceded to jurisdiction. Means you have to complete the process in Texas.
Read Marriage of Rabie, a CA case regarding fraud for some ideas.
Where would I find info about this case?
William3rd is a California immigration attorney that I have known on these boards for several years now. He has successfully argued a case for marriage annulment. I believe "Marriage of Rabie" was this case.
